Terms of Service

By accessing or using the NUTR8™ website (the “Site”) and any subscription or notification services offered through it (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site or Services.

• “Company” means NUTR8™, a Jamaican entity.
• “User” means any individual who accesses or uses the Site or Services.
• “Content” means all text, graphics, logos, and materials displayed on the Site.

Permitted Use

You may use the Site for lawful, personal, non-commercial purposes. You agree not to misuse the Services, introduce malware, scrape Content, or attempt to gain unauthorised access to our systems.

User Account Obligations

• Where an account is required, you must provide accurate, current information and keep it updated.
• You are responsible for safeguarding your password and for all activity under your account.
• You must notify us promptly of any unauthorised use of your account.
• You must be of legal age to form a binding contract under Jamaican law (18 years or older).

All Content on the Site — including the NUTR8™ name, logo, product designs, imagery, and copy — is owned by or licensed to the Company and is protected by Jamaican and international intellectual property laws.

• You may not reproduce, distribute, or create derivative works from the Content without our prior written consent.
• Trademarks, service marks, and trade names remain the exclusive property of the Company.
• User-submitted content, where applicable, remains owned by the user, who grants the Company a non-exclusive, royalty-free licence to use it for operating the Services.

Where the Services include subscriptions, the following apply:

• Pricing, plans, and availability are displayed on the Site and may change at any time without prior notice, except as required by law.
• By confirming a subscription, you authorise us to charge the applicable fees through our payment provider.
• Subscription plans renew automatically unless cancelled in accordance with the cancellation terms provided at sign-up.

The Site and Content are provided “as is” and “as available”. NUTR8™ juices are functional botanical beverages and are not intended to diagnose, treat, cure, or prevent any disease. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Site or Services.

You agree to indemnify and hold harmless the Company from any claim, loss, or damage arising from your breach of these Terms or your misuse of the Site or Services.

We may suspend or terminate your access to the Site or Services at any time, with or without cause or notice, including where we believe you have violated these Terms. Upon termination, all licences granted to you cease immediately. You may stop using the Site at any time.

These Terms are governed by and construed in accordance with the laws of Jamaica, and the courts of Jamaica shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

Cross-Border Consumer Protection

For Users accessing the Site from the United States or Canada, nothing in these Terms overrides mandatory consumer-protection rights afforded by the applicable jurisdiction, including US Federal Trade Commission regulations and Canadian provincial consumer-protection statutes. Where a conflict arises, the consumer-protection provisions of the User’s jurisdiction shall prevail to the extent required by law.

• Parties shall first attempt to resolve any dispute informally for a period of 30 days.
• Unresolved disputes shall be submitted to mediation in Jamaica before resorting to litigation.
• Where mediation fails, the dispute shall be brought before the competent courts of Jamaica, without prejudice to a consumer’s right to bring proceedings in their country of residence where mandatory law so requires.

We may revise these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
